Placing an Order

To place an order, visitors must visit the Website and register as a user, or, instead, place the order as guests without registering as a user, by filling out, on both cases the corresponding online form available at all times on the Website and following the instructions indicated on the Website.

To place an order, visitors must add the Product they wish to purchase to the shopping cart before proceeding to the checkout, following the on-screen instructions to complete and submit the order form provided.

Guerlain only sells products via the Website to final Consumers. Products are solely intended for the consumer personal use, excluding any connection to his/her professional capacity.

The prices and offers appearing on the Website are valid only for online orders placed at the Website and they may not coincide with the prices and offers available from other distributors of the Products. All prices published on the Website are in Saudi Riyal (SR) and inclusive of taxes.

By confirming an order, you expressly acknowledge and accept these Conditions as part of concluding the contract. Unless proven otherwise, the data recorded by the Website constitutes proof of all transactions carried out between Guerlain and its customers. Guerlain will store and provide access to the electronic document that formalizes the contract.

Once a purchase is made, a purchase confirmation will be sent by email as soon as possible within 24 hours after the purchase.

Guerlain will issue a soft copy invoice once the order leaves our warehouses and is proven paid that will be sent along the shipment confirmation email and which could be downloaded by going to the “My orders” section of the “My account” page. Guerlain warns that sales invoices cannot be modified once issued, without prejudice to your right to obtain a corrected invoice in those cases provided for under applicable regulations. The invoice will be issued in the name of the individual or company that places the order. It is therefore important to ensure that the order is placed using the correct name.

Product Availability

The selection of Products offered on the Website is valid as long as the Products appear on the Website, provided that Guerlain has stock available. As with all e-commerce, stock is updated online. It is therefore possible for stock to run out while completing the purchase process. In such cases, it will not be possible to continue the transaction that is underway.

Should a Product be out of stock or temporarily unavailable, Guerlain will contact you to advise accordingly and offer a new delivery date or cancel the order if the Product cannot be delivered.

Order Confirmation

After you confirm your order, it will be sent to Guerlain for processing. You will not be able to modify or cancel your order except under those situations set forth in the Conditions or the provisions established by the laws of the Kingdom of Saudi Arabia.

By confirming your order, you fully accept all the Conditions. You will be sent an email summarizing your order.

Payment Methods

Prices for Guerlain Products are indicated in Saudi Riyals (SR) and are inclusive of taxes.

Guerlain reserves the right to modify the prices of the Products on the Website at any time and without notice. Product invoicing will be based on the price list appearing on the Website at the time your order is confirmed, subject to the availability of the Products ordered at that time.

We accept the following means of payment: VISA, MASTER CARD, MADA, Apple Pay, and Cash-On-Delivery (for Orders below 4000 SAR).

Payments made through the Website will be processed online with the corresponding banking institution. The banking institution in question will be responsible for automatically storing and processing the information relative to different orders, including bank card data.

Your order will be processed once the purchase and payment processes have been fully completed.

Should any of the Products ordered not be available (see “Product Availability”), Guerlain shall inform the client about satisfactory alternatives or similar products and, in case the client chooses to give up with the purchase, the amount of the undelivered Products will be refunded to the bank card used to make the purchase, on the understanding that the order has been canceled.

Product Delivery

Delivery Address

Products purchased on the Website can only be delivered within the Delivery Zone.

Any delivery address located outside the Delivery Zone will be rejected during the order process.

Orders using a PO box as the delivery address will not be processed.

The merchandise will be sent to the delivery address within the Delivery Zone specified in the order.

Delivery Times

Deliveries will be made within two (2) to seven (7) business days. For the count of the delivery times, the following days will not be taken into account: Friday and any bank holiday in the Kingdom of Saudi Arabia. Ordered Products will be delivered during normal working hours at the address provided when placing the order, provided that payment has been confirmed. No deliveries will be made until payment has been received for the Products.

Delivery Problems

Every effort will be made to deliver the Products as fast as possible after the order is accepted.

Should you not receive your Product or should the delivery be delayed by more than eight (8) business days, you should contact Guerlain at customerserviceme@guerlain.fr.

In the event that there is nobody at the address provided to accept delivery of the Products, the courier company will contact you in order to agree upon a new delivery date or a location to pick up the Products.

When the order is delivered, you must check to ensure that the shipment is correct. If there is any discrepancy or problem with your order at the time of delivery, you must indicate the nature of the discrepancy or problem (for example, open package, damaged merchandise) on the delivery note and sign it. You must then contact the Online Orders Department by email via the Website’s “Contact us” section.

Upon accepting delivery, ownership of the Products and all risks associated with these are transferred to the recipient.

If the Products do not correspond to your order or you are not satisfied with them, you can exchange them for others or return them for a full refund in accordance with the conditions set forth in the “Return Policy” section.

Shipping Costs

Shipping and/or handling costs are included in the Product price for all shipments made in the Delivery Zone. An extra amount of 20 SAR (VTA included) will apply if you pay with Cash-on-Delivery.

Reception of the Products

On receipt of the Products, the Consumer undertakes to check the good condition of packaging and the conformity of the Products delivered with the order and inform Guerlain of any error, damage to packaging, or non-arrival as soon as possible.

Please note that make-up products (including without limitation mascara, lipstick powder, etc.) and personalized items (including without limitation to engraving fragrances & cosmetics, filling empty Bee Bottles, cap and ribbon personalization, and any customized alteration of the product’s original packaging) cannot be returned.

In the event that you are not satisfied with the Products purchased exclusively from the Website you have the right to return your purchase to our own online store in accordance with the provisions set forth in the following paragraphs.

You can exercise your right to return the Products purchased at the Website within seven (7) days from the date of receipt of the product. For returns, the Customer must contact us on customerserviceme@guerlain.fr so that we set up the return with our carrier.

To exercise your right to terminate your contract for Products purchased at the Website you must contact us in order to state your decision to terminate the contract on the following Online Orders email address: customerserviceme@guerlain.fr. The Products must be returned in their original condition and in their complete original packaging, unopened and sealed, along with any accessories associated with the Products (promotional gifts and samples offered should all be included).

Guerlain has sole discretion in determining whether the Products have been returned in their original condition. Products that are returned incomplete, broken, damaged, worn, unsealed, or used by the customer will not be subject to a refund. They will be made available to the sender or sent back at Guerlain’s discretion.

Guerlain disclaims all liability and responsibility for any loss, shipping delay, or delivery to an incorrect address of any article that you wish to return to the Website, insofar as you assume the risks associated with your chosen shipping method.

The customer is responsible for obtaining proof that the Products have been returned by sending these via certified mail or by any other means that provides a receipt indicating the date the shipment was postmarked and delivered.

In case of payment with Apple Pay or Debit/credit card, after receiving the Product, we will proceed with the aforementioned refund using the same payment method that was used to make the purchase.

In case of a payment using the Cash-On-Delivery option, we will proceed with the aforementioned refund using a voucher code or a bank transfer of the same amount of your purchase (not including the Cash-on-delivery cost).

يمكن لجميع مستخدمي الموقع الإلكتروني طباعة و/أو حفظ هذه الشروط بصيغة رقمية لقراءتها بمزيد من التفصيل.

تُوزَّع منتجات جيرلان (Guerlain) المعروضة على الموقع الإلكتروني حصريًا للمستهلكين النهائيين المتواجدين في المملكة العربية السعودية، ولأغراض الاستخدام الشخصي فقط (ويُشار إلى هذه المنطقة لاحقًا بـ "منطقة التوصيل").

يُعدّ أي طلب لا يندرج ضمن نطاق البيع بالتجزئة، أو يُشتبه في كونه احتياليًا أو تم تقديمه بطريقة احتيالية، باطلًا من قبل جيرلان (Guerlain)، ولن يتم معالجته.

كما سيتم رفض أي طلب يتضمن عنوان توصيل خارج منطقة التوصيل أثناء عملية الطلب.

تهدف شروط الاستخدام والشروط العامة للتعاقد (ويُشار إليهما لاحقًا معًا بـ "الشروط") إلى تنظيم استخدام الموقع الإلكتروني، وتوفير المعلومات المتاحة في المتجر الإلكتروني على الموقع، بالإضافة إلى تنظيم المعاملات التجارية التي تتم بين جيرلان (Guerlain) ومستخدمي اسم النطاق الخاص بالموقع الإلكتروني.

يُشار إلى شروط الاستخدام والشروط العامة للتعاقد مجتمعةً بـ"الشروط والأحكام".

يُعدّ تصفح المستخدم للموقع الإلكتروني بمثابة قبول كامل وغير مشروط لجميع شروط الاستخدام والشروط العامة للتعاقد، بالإضافة إلى سياسة الخصوصية وسياسة ملفات تعريف الارتباط (الكوكيز) الخاصة بالموقع.

يُحظر تمامًا استخدام الموقع الإلكتروني كليًا أو جزئيًا، لا سيما فيما يتعلق بتحميل أو نسخ أو نقل أو عرض محتواه، لأي غرض غير شخصي أو خاص أو غير تجاري.

تبذل جيرلان (Guerlain) أقصى جهودها لضمان أن تكون المعلومات المنشورة على الموقع دقيقة ومُحدّثة، وتحتفظ بالحق في تصحيح محتوى الموقع في أي وقت.

تُخلي جيرلان (Guerlain) مسؤوليتها بالكامل عن:

• أي غموض، أو عدم دقة، أو سهو، أو أي ضرر ناتج عن تدخل طرف ثالث قام بتعديل المعلومات الواردة على الموقع الإلكتروني.
• الأضرار الناتجة عن دخول غير مصرح به من طرف ثالث إلى الموقع الإلكتروني، أو عدم القدرة على الوصول إليه.

لا تتحمل جيرلان أي مسؤولية عن محتوى الصفحات الأخرى المرتبطة بالموقع الإلكتروني.

تُحيط جيرلان (Guerlain) مستخدمي الموقع علمًا بأن شروط الاستخدام قابلة للتعديل في أي وقت. تُصبح هذه التعديلات سارية المفعول فور نشرها على الموقع، ويُعدّ أي مستخدم يدخل إلى الموقع بعد ذلك موافقًا بالكامل على هذه التعديلات.

لذا، تقع على عاتق المستخدم مسؤولية قراءة شروط الاستخدام بعناية قبل تصفح الموقع.

كما تُحيط جيرلان (Guerlain) المستخدم بأنها قد تقوم بإيقاف أو تقييد الوصول إلى الموقع الإلكتروني في أي وقت لأغراض الصيانة أو الأمن أو لأي سبب آخر تراه ضرورياً.

يتحمّل المستخدمون المسؤولية كاملة عن استخدامهم للموقع الإلكتروني، وعن أي معلومات أو نصوص أو رسومات أو صور أو مواد أخرى قد يقومون بتحميلها أو نشرها على الموقع (ويُشار إليها مجتمعةً بـ "المحتوى الخاص بكم - Your Content")، وكذلك عن أي نتائج أو تبعات تترتب على ذلك. يُرجى العلم أن معظم المضمون الذي يقوم المستخدمون بإرساله أو نشره أو عرضه عبر الموقع يكون عامًا بشكل افتراضي، وقد يكون مرئيًا لمستخدمين آخرين أو من خلال خدمات ومواقع إلكترونية تابعة لأطراف ثالثة (باستثناء معلومات الشراء الخاصة، ما لم يتم تقديمها لأغراض أخرى غير الشراء). لذلك، يجب على المستخدمين نشر المحتوى الذي يشعرون بالارتياح لمشاركته مع الآخرين بموجب هذه الشروط والأحكام.

عند نشر محتواكم، فإنكم توافقون على عدم الإدلاء بأي تعليقات لا تستند إلى وقائع، بما في ذلك – على سبيل المثال لا الحصر – التعليقات العنصرية، أو استخدام الألفاظ النابية، أو الإساءة إلى مستخدم آخر، أو ازدراء ثقافة أخرى، أو أي تعليقات مهينة، أوغير لائقة. قد لا نقوم بمراقبة أو التحكم في محتواكم، ولا يمكننا تحمل أي مسؤولية عنه. إن أي استخدام أو اعتماد على محتواكم، أو على محتوى مقدم من أي طرف آخر غير جيرلان (مثل المستخدمين الآخرين) – ويُشار إليه بـ "المحتوى الآخر" – أو تم الحصول عليه من خلال الموقع الإلكتروني، يتم على مسؤوليتكم الخاصة. قد يخضع محتواكم للمراجعة، وقد يستغرق ما يصل إلى 48 ساعة قبل أن يتم عرضه، إلا أن جيرلان (Guerlain) لا تلتزم بمراجعة جميع محتواكم أو المحتوى الآخر، ولا تتحمل أي مسؤولية عن ذلك. إذا كان لديكم أي شكوى بشأن أي منشور، يُرجى عندها التواصل مع خدمة العملاء لدينا. تحتفظ جيرلان (Guerlain) بالحق، وفقًا لتقديرها المطلق، في عدم نشر أو إزالة أي محتوى من محتواكم أو من المحتوى الآخر إذا رأت أنه قد يكون غير قانوني، أو تشهيري، أو عنصري، أو مسيء للسمعة، أو إذا كان يحرض على الكراهية أو العنف، أو ضارًا بالأشخاص أو المؤسسات أو الأديان أو الخصوصية، أو يُعرض القُصّر للخطر، أو ينتهك العلامات التجارية أو براءات الاختراع أو حقوق النشر.

نحن لا نُصادق أو نؤيد أو نمثل أو نضمن اكتمال أو صحة أو دقة أو موثوقية المحتوى الآخر، كما لا نؤيد أي آراء يتم التعبير عنها من خلال الموقع الإلكتروني. أنتم تدركون أنه باستخدامكم للموقع، قد تتعرضون لمحتوى آخر قد يكون مسيئًا، أو ضارًا، أو غير دقيق، أو غير ملائم، أو في بعض الحالات، منشورات تم تصنيفها بشكل خاطئ أو مضللة بطريقة ما. وبأي حال من الأحوال، لن نكون مسؤولين بأي شكل من الأشكال عن أي من محتواكم أو المحتوى الآخر، بما في ذلك – على سبيل المثال لا الحصر – أي أخطاء أو سهو في محتواكم أو المحتوى الآخر، أو أي خسارة أو ضرر من أي نوع قد ينشأ نتيجة استخدام محتواكم أو المحتوى الآخر الذي تم نشره أو إرساله عبر البريد الإلكتروني أو نقله أو إتاحته بأي وسيلة عبر الموقع الإلكتروني أو من خلال أي وسيلة أخرى.

تحتفظون بكافة الحقوق المتعلقة بمحتواكم. وبقيامكم بتقديم أو نشر أو عرض محتواكم على الموقع الإلكتروني أو من خلاله، فإنكم تمنحوننا ترخيصًا عالميًا، غير حصريًا، وخاليًا من حقوق الملكية (مع الحق في الترخيص الفرعي)، وذلك لاستخدام ونسخ وإعادة إنتاج ومعالجة وتكييف وتعديل ونشر ونقل وعرض وتوزيع محتواكم عبر أي وسائط أو وسائل توزيع (سواء المعروفة حاليًا أو التي قد تُطوّر لاحقًا). كما توافقون على أن هذا الترخيص يشمل حق جيرلان (Guerlain) في تقديم خدماتها والترويج لها وتحسينها، وكذلك إتاحة محتواكم لشركات أو منظمات أو أفراد يتعاونون مع جيرلان لأغراض إعادة النشر، أو البث، أو التوزيع، أو النشر عبر وسائط وخدمات أخرى، وذلك وفقًا لشروط وأحكام استخدام المحتوى الخاصة بنا. وقد يتم استخدام محتواكم من قبل جيرلان (Guerlain) أو من قبل شركائها من الشركات أو المنظمات أو الأفراد دون أن يترتب على ذلك أي تعويض مالي لكم مقابل هذا الاستخدام.

يجوز لنا تعديل أو تكييف المحتوى الخاص بكم من أجل نقله أو عرضه أو توزيعه عبر شبكات الحاسوب وفي وسائط متعددة، و/أو إجراء التعديلات اللازمة على محتواكم ليتوافق ويتكيف مع أي متطلبات أو قيود خاصة بأي شبكات أو أجهزة أو خدمات أو وسائط. نحتفظ بالحق في جميع الأوقات (دون أن نكون ملزمين بذلك) في إزالة أو رفض توزيع أي من محتواكم، أو تعليق أو إنهاء حسابات المستخدمين (حيثما يكون الإنهاء مسموحًا به بموجب القوانين المعمول بها)، واسترداد أسماء المستخدمين دون أي مسؤولية تجاهكم. كما نحتفظ بالحق في الوصول إلى أي معلومات وقراءتها وحفظها والإفصاح عنها إذا كنا نعتقد بشكل معقول أن ذلك ضروري من أجل: (1) الامتثال لأي قانون أو لائحة أو إجراء قانوني أو طلب حكومي معمول به، (2) تنفيذ الشروط والأحكام، بما في ذلك التحقيق في الانتهاكات المحتملة لها، (3) اكتشاف أو منع أو معالجة الاحتيال أو مشاكل الأمان أو المشاكل التقنية بشكل أو بآخر، (4) الاستجابة لطلبات دعم المستخدمين، أو (5) حماية حقوق أو ممتلكات أو سلامة جيرلان (Guerlain) أو مستخدميها أو الجمهور.

لا يجوز لكم القيام بأي من الأفعال التالية أثناء الوصول إلى الموقع الإلكتروني أو استخدامه:  (1) الوصول إلى، أو العبث بـ، أو استخدام المناطق غير العامة من الموقع الإلكتروني، أو أنظمة الحاسوب الخاصة بنا، أو أنظمة التوصيل التقنية الخاصة بمزودي خدماتنا؛ (2) فحص أو مسح أو اختبار مدى ضعف أي نظام أو شبكة، أو خرق أو التحايل على أي تدابير أمنية أو إجراءات تحقق من الهوية؛ (3) الوصول إلى أو البحث في الموقع الإلكتروني أو محاولة ذلك بأي وسيلة (سواء آلية أو غير ذلك) غير تلك الواجهات المتاحة والمنشورة حاليًا من قبلنا (وفقط وفقًا للشروط والأحكام)، ما لم يُسمح لكم بذلك تحديدًا بموجب اتفاقية منفصلة معنا؛ (4) تزوير أي رأس حزمة TCP/IP أو أي جزء من معلومات الرأس في أي بريد إلكتروني أو منشور، أو استخدام الموقع بأي طريقة لإرسال معلومات معدّلة أو مضللة أو مزيفة تتعلق بمصدر الرسالة؛ (5) التدخل في أو تعطيل (أو محاولة القيام بذلك) وصول أي مستخدم أو مضيف أو شبكة، بما في ذلك، على سبيل المثال لا الحصر، إرسال فيروسات، أو التحميل الزائد، أو الإغراق، أو إرسال الرسائل غير المرغوب فيها، أو إغراق البريد الإلكتروني للموقع، أو عن طريق برمجة استخدام السكربتات لإنشاء محتواكم بطريقة تؤثر سلبًا أو تفرض عبئًا غير مبرر على الموقع.

يقتصر شراء المنتجات من خلال الموقع الإلكتروني على الأطراف القادرين قانونًا على إبرام العقود عبر الإنترنت، وذلك وفقًا لأحكام القوانين المعمول بها في المملكة العربية السعودية.

ولإتمام عمليات الشراء عبر الموقع، يتعين عليكم تقديم بياناتكم الشخصية، بما في ذلك الاسم الأول والاسم العائلي الحقيقيين، ورقم هاتف جوال صالح، وعنوان بريد إلكتروني فعّال، ومعلومات الدفع، وعنوان إرسال فواتير صحيح، وأي معلومات أخرى مطلوبة كما هو موضح. كما تُقرّون وتضمنون أن معلومات الدفع التي تقدمونها صحيحة وكاملة ودقيقة، وتؤكدون أنكم أنتم الأشخاص المشار إليهم في بيانات الفوترة المقدمة.

يتوفر الموقع الإلكتروني فقط للأشخاص الذين يستوفون شروط الأهلية الخاصة بـ جيرلان (Guerlain)، والذين يمتلكون بطاقة ائتمان أو خصم صالحة صادرة عن بنك معتمد من قبل جيرلان (Guerlain)، والذين منحوا الشركة التفويض اللازم لخصم المبلغ أو المبالغ المستحقة على بطاقتهم مقابل السعر الإجمالي للمنتج أو المنتجات التي يشترونها. تُشترى المنتجات للاستخدام الشخصي أو كهدايا فقط، ولا يجوز إعادة بيعها أو استخدامها لأغراض تجارية أو لتحقيق أي منفعة تجارية أخرى. كما وتحتفظ جيرلان (Guerlain) بالحق في تقييد شحن كميات متعددة من منتج واحد إلى أي عميل أو عنوان تسليم واحد.

من خلال تقديم عرض لشراء منتج أو منتجات، فإنكم تفوّضون صراحةً جيرلان (Guerlain) بإجراء فحوصات ائتمانية، ونقل أو الحصول على معلومات تتعلق بطاقة الائتمان/الخصم الخاصة بكم أو تقريركم الائتماني (بما في ذلك أي معلومات محدّثة) من أو إلى أطراف ثالثة، وذلك لأغراض التحقق من هويتكم، وتأكيد صلاحية بطاقتكم، والحصول على تفويض أولي لاستخدام البطاقة، و/أو تفويض المعاملات الشرائية الفردية، وذلك حسبما نراه ضروريًا. كما وتوافقون على أنه يجوز لنا استخدام المعلومات الشخصية التي تقدمونها لإجراء فحوصات مناسبة لمكافحة الاحتيال، وقد يتم الإفصاح عن هذه المعلومات الشخصية إلى وكالة مرجعية ائتمانية أو وكالة مختصة بمنع الاحتيال، والتي قد تحتفظ بسجل لتلك المعلومات.

تقديم طلب شراء

لإتمام طلب الشراء، يجب على الزائرين الدخول إلى الموقع الإلكتروني وتسجيل حساب مستخدم (User)، أو، بدلاً من ذلك، تقديم الطلب كزوار (Guests) دون تسجيل، وذلك من خلال تعبئة النموذج الإلكتروني المتاح في جميع الأوقات على الموقع، واتباع التعليمات الموضحة.

يجب على الزائرين إضافة المنتج الذي يرغبون في شرائه إلى سلة التسوق، ثم متابعة عملية الدفع من خلال اتباع التعليمات الظاهرة على الشاشة لاستكمال وتقديم نموذج الطلب.

تقوم جيرلان (Guerlain) ببيع المنتجات عبر الموقع الإلكتروني للمستهلكين النهائيين فقط. وتُخصص المنتجات للاستخدام الشخصي للمستهلك، ويُستثنى من ذلك أي استخدام يرتبط بصفته المهنية أو لأغراض تجارية.

تُعتبر الأسعار والعروض الظاهرة على الموقع الإلكتروني صالحة فقط للطلبات المقدمة عبر الإنترنت من خلال الموقع، وقد لا تتطابق مع الأسعار والعروض المتوفرة لدى موزعين آخرين لهذه المنتجات. جميع الأسعار المنشورة على الموقع الإلكتروني بالريال السعودي (ر.س)، وتشمل الضرائب المطبقة.

من خلال تأكيد الطلب، فإنكم تُقرّون صراحةً بقبول هذه الشروط كجزء من إبرام العقد. ما لم يُثبت خلاف ذلك، تُعد البيانات المسجلة عبر الموقع الإلكتروني دليلاً على جميع المعاملات التي تتم بين جيرلان (Guerlain) وعملائها. تقوم جيرلان بحفظ الوثيقة الإلكترونية التي تُشكّل العقد، وتتيح الوصول إليها عند الطلب.

وبمجرد إتمام عملية الشراء، سيتم إرسال تأكيد بالشراء عبر البريد الإلكتروني في أقرب وقت ممكن، وذلك خلال مدة لا تتجاوز 24 ساعة من تاريخ الشراء.

ستقوم جيرلان (Guerlain) بإصدار نسخة إلكترونية من الفاتورة عند شحن الطلب من مستودعاتنا وثبوت سداد قيمته. سيتم إرسال الفاتورة مع رسالة تأكيد الشحن عبر البريد الإلكتروني، كما يمكنكم تحميلها من خلال قسم "طلباتي – (My Orders)" في صفحة "حسابي – (My Account)" على الموقع الإلكتروني. تشير جيرلان إلى أن فواتير البيع لا يمكن تعديلها بعد إصدارها، وذلك دون الإخلال بحقكم في الحصول على فاتورة مصححة في الحالات التي تنص عليها الأنظمة المعمول بها. يتم إصدار الفاتورة باسم الفرد أو الجهة التي قامت بتقديم الطلب، لذا من المهم التأكد من إدخال الاسم الصحيح عند إتمام عملية الشراء.

توافر المنتجات

تظل مجموعة المنتجات المعروضة على الموقع الإلكتروني صالحة طالما أن هذه المنتجات ظاهرة على الموقع، بشرط توفّرها في مخزون جيرلان (Guerlain). وكما هو الحال في جميع مواقع التجارة الإلكترونية، يتم تحديث المخزون عبر الإنترنت، ولذلك من الممكن أن تنفد الكمية أثناء إتمام عملية الشراء. في مثل هذه الحالات، لن يكون من الممكن متابعة المعاملة الجارية.

في حال نفاد مخزون أحد المنتجات أو عدم توفره مؤقتًا، ستقوم جيرلان (Guerlain) بالتواصل معكم لإبلاغكم بذلك، واقتراح موعد تسليم جديد أو إلغاء الطلب إذا تعذّر تسليم المنتج.

تحتفظ جيرلان (Guerlain) بالحق في تعديل المنتجات المعروضة على الموقع الإلكتروني في أي وقت ودون إشعار مسبق. وعلى الرغم مما سبق، فإن جيرلان (Guerlain) ستبذل قصارى جهدها لتقديم بديل مرضٍ للعميل.

تأكيد طلب الشراء

بعد تأكيدكم لطلب الشراء، سيتم إرساله إلى جيرلان (Guerlain) لمعالجته. ولا يمكنكم تعديل الطلب أو إلغاؤه إلا في الحالات المنصوص عليها في الشروط أو وفقًا للأحكام التي تقرّها قوانين المملكة العربية السعودية.

وبتأكيدكم لطلب الشراء، فإنكم تقرّون بقبول جميع الشروط بشكل كامل. سيتم إرسال بريد إلكتروني إليكم يتضمّن ملخصًا لهذا الطلب.

طرق الدفع

تُعرض أسعار منتجات جيرلان (Guerlain) بالريال السعودي (ر.س) وتشمل الضرائب.

تحتفظ جيرلان (Guerlain) بالحق في تعديل أسعار المنتجات المعروضة على الموقع الإلكتروني في أي وقت ودون إشعار مسبق. ويتم احتساب سعر المنتج وفقًا للقائمة الظاهرة على الموقع في وقت تأكيد الطلب، وذلك رهناً بتوفّر المنتجات المطلوبة في حينه.

يمكنكم الدفع باستخدام إحدى الوسائل التالية: فيزا (VISA)، ماستركارد (MASTER CARD)، مدى (MADA)، أبل باي (Apple Pay)، والدفع عند الاستلام (للطلبات التي تقل عن 4000 ريال سعودي).

تُعالج المدفوعات التي تتم عبر الموقع الإلكتروني مباشرة عبر المؤسسة المصرفية المعنية، والتي تتولى مسؤولية حفظ ومعالجة معلومات الطلبات المختلفة تلقائيًا، بما في ذلك بيانات بطاقات الدفع.

سيتم البدء في معالجة الطلب بعد إتمام عمليتي الشراء والدفع بشكل كامل.

وفي حال عدم توفر أي من المنتجات المطلوبة (يرجى الرجوع إلى قسم "توفر المنتجات")، ستقوم جيرلان (Guerlain) بإبلاغ العميل بالبدائل المناسبة أو المنتجات المشابهة. وإذا قرر العميل إلغاء الشراء، فسيتم رد المبلغ المدفوع مقابل المنتجات غير المتوفرة إلى بطاقة الدفع المستخدمة، على أساس أن الطلب قد تم إلغاؤه.

تسليم المنتجات

عنوان التسليم

يمكن توصيل المنتجات التي يتم شراؤها عبر الموقع الإلكتروني فقط ضمن نطاق التوصيل المحدد.

سيتم رفض أي عنوان توصيل يقع خارج نطاق التوصيل أثناء عملية الطلب.

كما لن تتم معالجة الطلبات التي يتم فيها استخدام صندوق بريد كعنوان للتوصيل.

سيتم إرسال المنتجات إلى عنوان التوصيل الواقع ضمن نطاق التوصيل، كما هو محدد في تفاصيل الطلب.

أوقات التسليم

يتم التوصيل خلال فترة تتراوح بين يومين (2) إلى سبعة (7) أيام عمل. ولا تُحتسب أيام الجمعة أو الإجازات الرسمية في المملكة العربية السعودية ضمن أيام العمل المعتمدة لحساب مدة التوصيل.

يتم تسليم المنتجات المطلوبة خلال ساعات العمل الرسمية إلى العنوان المحدد عند إتمام الطلب، وذلك بشرط تأكيد الدفع.

لن يتم تنفيذ أي عملية توصيل قبل استلام الدفعة الخاصة بالمنتجات.

مشكلات التسليم

تبذل جيرلان (Guerlain) أقصى جهودها لتوصيل المنتجات في أسرع وقت ممكن بعد قبول الطلب.

في حال عدم استلامكم للمنتج أو تأخر التوصيل لأكثر من ثمانية (8) أيام عمل، يُرجى التواصل مع جيرلان (Guerlain) عبر البريد الإلكتروني customerserviceme@guerlain.fr.

في حال عدم تواجد أحد في العنوان المحدد لاستلام الطلب عند التوصيل، ستقوم شركة الشحن بالتواصل معكم لتحديد موعد جديد للتوصيل أو موقع بديل لاستلام المنتجات.

عند استلام الطلب، يجب التحقق من صحة الشحنة. وفي حال وجود أي خلل أو مشكلة في الطلب عند التوصيل (مثل الطرد المفتوح أو تلف في المنتج)، يجب توضيح طبيعة المشكلة على إيصال التوصيل والتوقيع عليه، ثم التواصل مع قسم الطلبات عبر الإنترنت من خلال قسم "اتصل بنا" (Contact us) على الموقع الإلكتروني.

بمجرد استلام الطلب، تنتقل ملكية المنتجات وجميع المخاطر المرتبطة بها إلى المستلم.

إذا لم تكن المنتجات مطابقة لطلبكم أو لم تكن مرضية، يمكنكم استبدالها أو إرجاعها واسترداد المبلغ بالكامل، وذلك وفقًا للشروط الموضحة في قسم "سياسة الإرجاع" (Return Policy).

تكاليف الشحن

تشمل أسعار المنتجات جميع تكاليف الشحن و/أو التسليم لجميع الشحنات التي تتم ضمن نطاق التوصيل. يُضاف مبلغ إضافي قدره 20 ريالًا سعوديًا (شامل الضريبة على القيمة المضافة) في حال اختيار الدفع عند الاستلام.

استلام المنتجات

عند استلام المنتجات، يلتزم المستهلك بالتحقق من سلامة التغليف ومطابقة المنتجات المستلمة لطلب الشراء، وإبلاغ جيرلان (Guerlain) بأي خطأ أو تلف في التغليف أو عدم استلام المنتجات، وذلك في أقرب وقت ممكن.

في حال عدم رضاكم عن المنتجات التي تم شراؤها حصريًا من الموقع الإلكتروني، يحق لكم إرجاع مشترياتكم إلى متجرنا الإلكتروني وفقًا للأحكام الموضحة في الفقرات التالية.

يمكنكم ممارسة حقكم في إرجاع المنتجات التي تم شراؤها من الموقع خلال سبعة (7) أيام من تاريخ استلام المنتج.

لإتمام عملية الإرجاع، يجب على العميل التواصل معنا عبر البريد الإلكتروني customerserviceme@guerlain.fr وذلك لترتيب عملية الإرجاع مع شركة الشحن المعتمدة لدينا.

لممارسة حقكم في فسخ عقد الشراء، يجب التواصل معنا عبر البريد الإلكتروني المذكور أعلاه لإبلاغنا بقراركم. كما يجب إعادة المنتجات في حالتها الأصلية وضمن تغليفها الأصلي الكامل، غير مفتوحة وغير مستخدمة، ومختومة، مع جميع الملحقات المرتبطة بها (بما في ذلك الهدايا الترويجية والعينات المجانية إن وُجدت).

تحتفظ جيرلان (Guerlain) بحقها الحصري في تحديد ما إذا كانت المنتجات قد أُعيدت في حالتها الأصلية. لن تُقبل المنتجات المُعادة إذا كانت ناقصة، مكسورة، تالفة، غير مختومة، مستعملة، أو تظهر عليها أي علامات استخدام. وفي هذه الحالات، تحتفظ جيرلان (Guerlain)  بالحق في إما إعادة إرسال المنتج إلى العميل أو الاحتفاظ به، وذلك وفقًا لتقديرها الخاص.

تُخلي جيرلان (Guerlain) مسؤوليتها عن أي خسارة أو تأخير في الشحن، أو تسليم منتج تمت اعادته إلى عنوان غير صحيح، طالما أن العميل يتحمل كامل المخاطر المرتبطة بطريقة الشحن التي اختارها.

يتحمل العميل مسؤولية إثبات إعادة المنتجات، وذلك من خلال إرسالها عبر البريد المضمون أو أي وسيلة أخرى توفر إيصالًا يوضح تاريخ الإرسال والاستلام.

في حال الدفع باستخدام أبل بايApple Pay  أو بطاقة الخصم/الائتمان، سيتم رد المبلغ باستخدام نفس وسيلة الدفع بعد استلام المنتج.

أما في حال الدفع باستخدام خيار الدفع عند الاستلام، فسيتم رد المبلغ إما عبر قسيمة شرائية أو تحويل بنكي بقيمة المشتريات (باستثناء رسوم الدفع عند الاستلام).

ينطبق حق فسخ العقد الموضح في هذا القسم فقط على المنتجات التي تم شراؤها حصريًا من الموقع الإلكتروني، ولا ينطبق بأي حال من الأحوال على المنتجات التي تم شراؤها من المتاجر الفعلية.

يُعد الموقع الإلكتروني عملاً إبداعيًا أصليًا ومحميًا بموجب القوانين المتعلقة بحماية الملكية الفكرية. ويُعتبر الموقع وجميع العناصر التي يتكوّن منها ملكية حصرية لدى جيرلان (Guerlain) أو الشركات التابعة لها. يُحظر تمامًا نسخ أو عرض أو تعديل الموقع أو أي من عناصره، كليًا أو جزئيًا، دون إذن مسبق. كما تُعد العلامات التجارية وأسماء النطاقات الظاهرة على الموقع ملكية حصرية لدى جيرلان (Guerlain) أو الشركات التابعة لها، ويُمنع تمامًا أي استخدام أو نسخ غير مصرح به لهذه العلامات أو الأسماء، بغض النظر عن الطريقة أو الغرض. لقد بذلت جيرلان (Guerlain)  جميع الجهود المعقولة لضمان دقة المعلومات المتوفرة على الموقع، إلا أنها لا تقدم أي ضمان صريح أو ضمني بشأن دقة أو شمولية أو حداثة هذه المعلومات. كما تُخلي جيرلان (Guerlain) مسؤوليتها عن أي ضرر مباشر أو غير مباشر من أي نوع قد ينجم عن استخدام الموقع الإلكتروني.

تشمل جميع المواد المعروضة على الموقع الإلكتروني مثل الرسومات، كود المصدر، التصاميم، الرسوم التوضيحية، الصور، التسجيلات الصوتية، النصوص المكتوبة، الشعارات، العلامات التجارية، وغيرها من العلامات المميزة الظاهرة على الموقع ملكية حصرية لدى جيرلان (Guerlain) أو إحدى الشركات التابعة لها، وهي محمية بموجب قوانين الملكية الفكرية والصناعية المعمول بها. يُحظر تمامًا استخدام أو نسخ أو توزيع أو نشر أو تعديل أو تنفيذ أي نشاط مشابه أو مماثل لأي من هذه المواد، كليًا أو جزئيًا، دون الحصول على موافقة خطية مسبقة من جيرلان (Guerlain). يُمنح المستخدم ترخيصًا محدودًا لاستخدام محتوى الموقع، يقتصر على تحميل المحتوى للاستخدام الشخصي فقط، بشرط أن يظل المحتوى محفوظًا بصيغته الأصلية دون أي تعديل.

يُحظر تمامًا استخدام الموقع الإلكتروني، كليًا أو جزئيًا، لا سيما لأغراض مثل التحميل أو النسخ أو النقل أو العرض لمحتواه، لأي غرض غير الاستخدام الشخصي، الخاص، وغير التجاري.

علامة جيرلان (Guerlain) التجارية، وجميع العلامات والشعارات الأخرى المرتبطة بها — سواء أكانت مسجلة أم غير مسجلة — بالإضافة إلى اسم النطاق، تُعد ملكية حصرية لـ جيرلان (Guerlain) أو الشركات التابعة لها، وستظل كذلك.

كما يُمنع منعًا باتًا نسخ أو توزيع أو نشر أو نقل أو تعديل أو استخدام هذه العلامات التجارية أو الشعارات، كليًا أو جزئيًا، أو القيام بأي نشاط مشابه أو مماثل، لأي غرض كان، دون الحصول على موافقة خطية صريحة ومسبقة من جيرلان (Guerlain).

لا يجوز لكم إزالة أي إشارة إلى حقوق النشر أو العلامات التجارية أو أي إشعارات أخرى تتعلق بحقوق الملكية الواردة على الموقع الإلكتروني أو ضمن أي محتوى آخر منشور عليه. يجوز لكم نسخ صفحات الموقع الإلكتروني للاستخدام الشخصي أو الخاص، أو لأغراض غير ربحية وغير تجارية، شريطة أن تتضمن أي نسخة يتم إنشاؤها جميع الإشعارات المتعلقة بحقوق النشر أو حقوق المؤلف، وأي إشعارات أخرى تتعلق بحقوق الملكية الواردة في المحتوى الأصلي.

نظرًا للطبيعة الديناميكية والمتغيرة باستمرار للمعلومات والخدمات المقدّمة عبر الموقع الإلكتروني، وعلى الرغم من بذل جيرلان (Guerlain) أقصى الجهود، لا يمكنها ضمان دقة أو موثوقية أو فائدة أو حداثة أو صحة جميع محتويات الموقع بشكل كامل.

قد تخضع المعلومات المنشورة على الموقع لتحديثات أو تعديلات دورية دون إشعار مسبق، وذلك بهدف التوسيع أو التحسين أو التصحيح أو التحديث.

تُخلي جيرلان (Guerlain) مسؤوليتها عن أي أضرار محتملة قد تنجم عن عدم توفر الموقع أو انقطاع الخدمات المقدّمة من خلاله.

كما لا تضمن جيرلان (Guerlain) خلو الموقع من الفيروسات أو أي عناصر تقنية قد تؤثر على أجهزتكم. وتُعفي نفسها من أي مسؤولية تعاقدية أو غير تعاقدية تجاه أي شخص أو جهة تستخدم الموقع وتتعرض لأضرار من أي نوع نتيجة فيروسات أو برامج خبيثة أو رموز برمجية ضارة.

تُخلي جيرلان (Guerlain) مسؤوليتها عن الأمور التالية:

• أي غموض أو عدم دقة أو سهو أو ضرر ناتج عن تدخل طرف ثالث غير مصرح له أدى إلى تعديل المعلومات الواردة على الموقع الإلكتروني؛ أو
• أي ضرر ناتج عن دخول غير مصرح به من طرف ثالث إلى الموقع الإلكتروني أو عن عدم القدرة على الوصول إلى الموقع.

التعويض

توافقون، بناءً على طلبنا، للدفاع عن جيرلان والشركات التابعة لها، وتعويضهما، وحمايتهما من أي أضرار، أو مطالبات، أو تكاليف، أو نفقات، بما في ذلك أتعاب المحاماة، الناشئة عن أو المتعلقة باستخدامكم للموقع الإلكتروني، أو أي خرق من قبلكم لهذه الشروط والأحكام، أو استخدام أي شخص آخر للموقع الإلكتروني عبر حساب الإنترنت الخاص بكم. تحتفظ جيرلان بالحق، وعلى نفقتها الخاصة، في تولي السيطرة الحصرية على أي مسألة تخضع لتعويضكم بموجب هذه الشروط، ويظل هذا الحق وحق التعويض قائمين بعد انتهاء هذه الشروط والأحكام واستخدامكم للموقع الإلكتروني.

التوافر

أنتم تقرّون بأن(1)  من الناحية التقنية، من المستحيل توفير الموقع الإلكتروني خالياً تماماً من العيوب، ولا تتحمل جيرلان (Guerlain) أي مسؤولية عن ذلك،(2)  أن هذه العيوب قد تؤدي إلى عدم توفر الموقع مؤقتاً،(3)  وأن تشغيل الموقع قد يتأثر سلباً بظروف وأداءات خارجة عن سيطرة جيرلان (Guerlain)، مثل، على سبيل المثال، روابط النقل والاتصالات بينكم وبين جيرلان (Guerlain) أو أنظمة وشبكات أخرى.

يجوز لـ جيرلان (Guerlain) في أي وقت، بشكل مؤقت أو دائم، تعديل أو إيقاف كل أو جزء من الموقع من أجل إجراء أعمال صيانة و/أو إدخال تحسينات و/أو تغييرات على الموقع. ولا تتحمل جيرلان (Guerlain) أي مسؤولية عن أي تعديل أو تعليق أو انقطاع في الموقع.

إخلاء المسؤولية

يتم توفير موقعنا الإلكتروني من قبل جيرلان (Guerlain) على أساس "كما هو" و"كما هو متاح". ولا تقدم جيرلان (Guerlain) أي تعهدات أو ضمانات من أي نوع، صريحة أو ضمنية، بشأن تشغيل الموقع الإلكتروني أو المعلومات أو المحتوى أو المواد أو المنتجات المدرجة فيه. وبأقصى حد يسمح به القانون المعمول به، تُخلي جيرلان (Guerlain) مسؤوليتها عن جميع الضمانات، الصريحة أو الضمنية، بما في ذلك، على سبيل المثال لا الحصر، الضمانات الضمنية الخاصة بقابلية التسويق، والملاءمة لغرض معين، والجودة المقبولة، والعناية والمهارة المعقولة، أو عدم الانتهاك. ودون الإخلال بما سبق، تُخلي جيرلان (Guerlain) مسؤوليتها عن أي وجميع الضمانات، الصريحة أو الضمنية، المتعلقة بأي بضائع معروضة على موقعنا الإلكتروني. وباستخدامكم للموقع، تُقرّون أن الاستخدام يتم على مسؤوليتكم الخاصة بالكامل. ولا ينطبق هذا الإخلاء من المسؤولية على أي ضمان يقدمه مُصنّع المنتج. كما ويُشكّل هذا الإخلاء جزءًا أساسيًا من هذه الشروط والأحكام.

الحد من المسؤولية

لا يُقصد من أي بند وارد في هذه الشروط والأحكام التأثير على حقوقكم كمستهلكين بموجب القوانين المعمول بها في المملكة العربية السعودية.

إن استخدامكم للموقع الإلكتروني أو لأي من الخدمات أو المنتجات المتاحة عليه يتم على مسؤوليتكم الخاصة، ما لم يُنص على خلاف ذلك في هذه الشروط والأحكام، وتتحملون كامل المسؤولية والمخاطر الناجمة عن هذا الاستخدام، بما في ذلك أي خسائر قد تترتب عليه.

وفي جميع الأحوال، وتحت أي نظرية قانونية أو إنصاف، سواء كانت مسؤولية تقصيرية أو تعاقدية أو مسؤولية موضوعية أو غير ذلك، لا تتحمل "جيرلان" أو أي من الشركات التابعة لها أو موظفيها أو مديريها أو مسؤوليها أي مسؤولية تجاهكم أو تجاه أي طرف آخر عن أي خسائر أو أضرار غير مباشرة أو خاصة أو عرضية أو تبعية من أي نوع، تنشأ عن أو تتعلق باستخدام الموقع أو بعدم القدرة على استخدامه، بما في ذلك – على سبيل المثال لا الحصر – الأضرار الناتجة عن فقدان الأرباح، أو فقدان السمعة التجارية، أو فقدان البيانات، أو توقف الأعمال، أو عدم دقة النتائج، أو تعطل أو فشل أنظمة الحاسوب، حتى وإن تم إخطار ممثل معتمد من "جيرلان" بإمكانية حدوث مثل هذه الأضرار أو كان من المفترض أن يكون على علم بها.

وبناءً على ما سبق، لا تتحمل "جيرلان" في أي حال من الأحوال مسؤولية عن أي أضرار تتجاوز المبلغ الذي دفعتموه مقابل المنتج الذي صدرت بشأنه المطالبة. وبموجب ذلك، تُقرّون بإعفائنا من أي التزامات أو مسؤوليات أو مطالبات تتجاوز هذا الحد من المسؤولية.

يخضع الدخول إلى الموقع الإلكتروني وكذلك استخدام محتواه للشروط المنصوص عليها في شروط استخدام موقع جيرلان (Guerlain).

تخضع هذه الشروط والأحكام لأنظمة المملكة العربية السعودية، وتكون محاكم مدينة جدة، في المملكة العربية السعودية، هي المختصة حصريًا بالنظر في أي نزاع ينشأ بموجبها.

وقد تم إعداد هذه الشروط والأحكام باللغتين العربية والإنجليزية، وفي حال وجود أي تعارض بين النصين، يُعتمد النص الإنجليزي.

يتم التواصل بين الطرفين عبر البريد الإلكتروني، وهو ما يقرّ به المستهلك ويقبله. ويُعدّ حفظ الطلب على أنظمة الحاسوب الخاصة بـ جيرلان (Guerlain)، إلى جانب تأكيد الطلب وأي مراسلات بين الطرفين، دليلاً على إبرام العقد.

تُعدّ السجلات الإلكترونية المخزّنة في أنظمة الحاسوب الخاصة بـ جيرلان (Guerlain) وشركائها دليلاً على جميع المراسلات والطلبات والمدفوعات التي تتم بين الطرفين.

ويحق للمستهلك، في أي وقت، الوصول إلى تفاصيل طلب/طلبات الشراء الخاصة به من خلال تقديم طلب عبر نموذج الاتصال المتاح على الموقع الإلكتروني.
